JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 04-04-2023 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners apprehend their arrest in connection with Kurhani P.S. Case No. 317 of 2022 registered for the offences punishable under Sections 341, 323, 307, 354(B) and 379/34 of the Indian Penal Code .

As per the prosecution case, the accused persons planting paddy on the land of the informant and when the informant objected, all the accused persons assaulted her with fists and legs and also assaulted her husband with iron rod. Learned counsel for the petitioner submitted that due to land dispute , altercation took place between the parties.

Patna High Court CR. MISC. No.70344 of 2022(2) dt.04-04-2023 2/2 Petitioner no. 1 is own brother of husband of the informant. There is no specific allegation against the petitioners, injury allegedly caused by this petitioners are simple in nature. Petitioners have clean antecedent.

Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that petitioner, in the event of his arrest/ surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) each with two sureties of the like amount to the satisfaction of the learned Chief Judicial Magistrate, Muzaffarpur in Kurhani P.S. Case No. 317 of 2022, subject to condition as laid down under Section 438(2) of the Cr.P.C.
