The petitioner seeks bail in a case registered under Sections 341, 323, 307, 379, 504, 506/34 of the Indian Penal Code.
Allegation against the petitioner is that he inflicted kulhari blow on the head of the informant, due to which he sustained head injury.
It has been submitted on behalf of the petitioner that the petitioner is in custody since 28.08.2019 and has got no criminal antecedent. Charge sheet has been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioner. For petty reason the alleged occurrence is
Patna High Court CR. MISC. No.63649 of 2019(2) dt.21-10-2019 2/2 said to have taken place. A single axe blow is alleged to have given. No repetition of blow has been made. No offence under Section 307 of the I.P.C. is made out. It is further submitted that the petitioner may be released on bail after completion of six months in custody from 28.08.2019.
On behalf of the State, it is submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail after completion of six months in custody from 28.08.2019 on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate 14th, Gopalganj in connection with Barauli P.S. case No.230 of 2019.
