The petitioner seeks pre-arrest bail in connection with Chhatapur P.S. Case No. 12 of 2017 registered under Sections 406 and 420 of the Indian Penal Code. It is submitted by the learned counsel for the petitioner that co-accused Dilip Singh, the Chairman of PACCS having more serious allegation than the petitioner has already
Patna High Court Cr.Misc. No.49754 of 2017 (3) dt.09-11-2017 been granted pre-arrest bail by a Bench of this Court vide order dated 28.06.2017 passed in Cr. Misc. No.17475 of 2017 as contained in Annexure-18 to the present application. Learned counsel for the State opposed the application for grant of pre-arrest bail to the petitioner. However, he admitted that co-accused Dilip Singh has already been granted pre-arrest bail by this Court.
Considering the reasons assigned in the aforesaid order dated 28.06.2017 passed in Cr. Misc. No.17475 of 2017, in the event of arrest or surrender in the court below within six weeks from today, the petitioner is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-IV, Supaul in connection with Chhatapur P.S. Case No. 12 of 2017 subject to the conditions as laid down under Section 438(2) Cr. P.C.
