JUSTICE VINOD KUMAR SINHA ORAL ORDER 13-01-2020 Petitioner seeks regular bail in connection with Darauli P.S. Case No. 139 of 2019 registered for the offences punishable under Sections 272, 273, 420, 120B of the Indian Penal Code and Section 30(a), 38(1) of the Bihar Prohibition and Excise Act, 2016.

As per prosecution case, the police on information that huge quantity of liquor has been brought by the truck, police raided the place of occurrence and saw some persons loading the liquor from the truck to the Bolero vehicle and some other vehicle. Petitioners were arrested from the Bolero vehicle. There is recovery of 273.8 liters of liquor from the Bolero vehicle.

Patna High Court CR. MISC. No.71479 of 2019(2) dt.13-01-2020 2/2 Submission of the learned counsel for the petitioners is that they were only loader and they have falsely been implicated in this case on the basis of confession. They are in custody for four and half months, having no criminal antecedent.

Heard learned A.P.P. also.

Having heard both sides, in view of the recovery, at this stage, I am not inclined to grant bail to the petitioners. However, once the charge has been framed, they are at liberty to renew their prayer for bail.

With the above observations, this application is dismissed.
