The sole petitioner, apprehending his arrest in connection with Tajpur P.S. Case No. 412 of 2017 , registered for offence under Section 272, 273 of the Indian Penal Code , 1860 and Section 30(a), 38(1), 38(2), 41(1), 41(2) of the Bihar Prohibition and Excise Act, 2016, has prayed for grant of bail in the event of his arrest or surrender.
It was submitted by learned counsel for the petitioner that save and except confessional statement of the co-accused , there is no other material to connect the petitioner in the present case. Besides this, it has been argued by way of referring to the statement made in paragraph no. 3 of the petition that petitioner
Patna High Court Cr.Misc. No.23484 of 2018(2) dt.23-04-2018 2/2 is having clean antecedent.
Considering the fact that petitioner's name has come on confessional statement as well as clean antecedent, in the event of his arrest or surrender within a period of six weeks from today, let the petitioner Harish Chandra Singh be enlarged on bail on furnishing bail bond of Rs. 10,000/- ( rupees ten thousand ) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-VI- cumSpecial Judge, Excise, Samastipur / concerned court in connection with Tajpur P.S. Case No. 412 of 2017 subject to the conditions as contemplated under Section 438 (2) of the Code of Criminal Procedure, 1973.
