JUSTICE VINOD KUMAR SINHA ORAL ORDER 13-01-2020 The petitioner seeks regular bail in connection with Sakari P.S. Case No. 79 of 2018, registered for offences punishable under Section 395 of the Indian Penal Code. Prosecution case is that some miscreants looted away Bolero Pick -up Van of the petitioner loaded with 51 bags of green chilly.

It has been submitted on behalf of the petitioner that he has falsely been implicated in this case on the basis of confession of co-accused and except that there is nothing against the petitioner and he has no criminal antecedent and has been in judicial custody for four and half months and chargesheet has been submitted and there is no chance of tampering with the evidence.

Heard learned A.P.P. also.

No.71462 of 2019(2) dt.13-01-2020 2/2 Having heard both sides, in view of the above facts, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Madhubani, in connection with Sakari P.S. Case No. 79 of 2018, subject to the condition that petitioner will cooperate in disposal of trial and make himself available as and when required by the court below, failing which, the prosecution shall move for cancellation of his bail bonds.
