The petitioner is apprehending his arrest in connection with Sarmea P.S.Case No.81/19 registered for offences punishable under Sections 341, 232, 353, 504 of the Indian Penal Code.

As per FIR, petitioner is said to have assaulted the informant, who is Incharge Medical Officer of the Primary Health Centre.

Submission of the learned counsel for the petitioner is that cousin brother of the petitioner met with an accident and received injuries, who was brought to the Hospital and as the petitioner has protested the behaviour of the informant and others in treatment, he has been made accused in this case. Heard learned A.P.P. also.

Patna High Court CR. MISC. No.64793 of 2019(2) dt.16-10-2019 2/2 Havi2019ng heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant privilege of anticipatory bail to the petitioner, however, if the petitioner surrenders before the learned court below and make prayer for regular bail, which will be considered by the learned court below without being prejudiced by the order of this Court and if possible to be disposed of on the same day. With the aforesaid direction, this application is dismissed.
