Mr.Shyam Bihari Singh ====================================================== CORAM: HONOURABLE MR. JUSTICE DINESH KUMAR SINGH ORAL ORDER 06-03-2020 Heard learned counsel for the petitioner and learned APP for the State.

The petitioner is apprehending his arrest in a case registered for the offence punishable under Section 392 of the Indian Penal Code.

It is alleged by the informant that on 30.01.2018 at 9.00 A.M., Rs.95,290/- was robbed off by four miscreants. Subsequently, co-accused Md. Arshad was arrested in Forbesganj P.S. Case No. 412 of 2018 wherein he disclosed the name of the petitioner as one of his accomplice as well as co-accused Mantosh Manjhi.

It is submitted by learned counsel for the petitioner

No.73689 of 2019(3) dt.06-03-2020 2/3 that except confessional statement of the co-accused, there is no cogent material against the petitioner and the petitioner has not been put on T.I. Parade, and a statement has been made in paragraph no. 3 of the petition that the petitioner is not having any criminal antecedent. Moreover, co-accused Md. Arshad and Mantosh Manjhi have already been granted bail.

Learned APP after going through the case diary submits that the name of the petitioner sprang up on the confession of the co-accused Md. Arshad.

Considering the fact that there is no recovery from the conscious physical possession of the petitioner, the petitioner has not been put on T.I. Parade, and the coaccused on whose confession, the name of the petitioner sprang up, has already been granted bail, coupled with the statement made in paragraph 3 of the petition that the petitioner is not having any criminal antecedent, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial
