JUSTICE SANJAY PRIYA ORAL ORDER 06-12-2017 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in Turkauliya P.S. Case No. 611 of 2016 instituted for the offence under Sections 147. 148, 149, 341, 323, 324, 307, 325, 354(b), 379, 427, 504 and 506 of the Indian Penal Code.

It is alleged in the written report that this petitioner fired from Nalkatua causing injury in the chest of son of the informant. The injury report has been enclosed as Annexure-2 wherein the Doctor has stated that a round metallic foreign body visualized in right upper chest and Metallic foreign body extracted from chest wall right side. Although, the Doctor has opined the injury to be simple in nature, but, there is specific allegation against the petitioner of causing firearm injury in the chest of the

Learned counsel for the informant has appeared and submitted that there is specific allegation against the petitioner of causing fiream injury in the chest of son of the informant. Therefore, this Court is not inclined to grant anticipatory bail to the petitioner.

Prayer for anticipatory bail of the petitioner stands rejected.

Petitioner may surrender before the court below and make prayer for regular bail which shall be considered/disposed off by the court below in accordance with law without being prejudiced by this order.
