1. Though the present petition has been filed for quashing the order dated 12.12.2023, passed by the District Magistrate, Buxar, in Arms Case No.607 of 2023, whereby and whereunder the arms license of the petitioner, bearing License No.71/95 has been cancelled, on the ground that he has not got the arms license renewed despite lapse of about 11 years as also for quashing the order dated 11.06.2024, passed by the Commissioner, Patna Division, Patna, rejecting the appeal, filed by the petitioner, however, at the outset, the learned counsel for the petitioner seeks liberty on behalf of the petitioner to file fresh application for grant of arms license, as per the provisions, contained under the Arms Rules, 2016, however, seeks a direction upon the competent authority to consider the same, in

Patna High Court CWJC No.16114 of 2024(2) dt.23-10-2024 2/2 accordance with law and dispose off the same within a stipulated time frame.

2. Per contra, the learned counsel for the respondentState submits that in case appropriate application is filed by the petitioner for grant of arms license, the same would definitely be considered in accordance with law and a final decision shall be taken, forthwith.

Having regard to the facts and circumstances of the case, I deem it fit and proper to grant liberty to the petitioner to file appropriate application for grant of arms license, in accordance with the provisions contained under the Arms Rule, 2016, within a period of four weeks from today and in case such an application is filed, the District Magistrate, Buxar shall consider the same, in accordance with law and take a final decision within a period of six weeks, thereafter.

4. The writ petition stands disposed off on the aforesaid terms.
