2. Learned counsel for the petitioner has submitted that though the earlier anticipatory bail petition of the petitioner was rejected by this Court vide order dated 22.03.2023 in Cr. Misc. No. 55609 of 2022 but he is renewing the prayer for bail on the ground that on exactly similar footing, co-accused Pawan Thakur and Abhishek Kumar have been granted bail by a coordinate Bench of this Court in Cr. Misc. No. 17793 of 2023 and the petitioner is languishing in custody for a period of more than one and half years.
3. Considering the above-mentioned facts and circumstances, let the petitioner above-named be released on bail
Patna High Court CR. MISC. No.76029 of 2023(3) dt.19-01-2024 2/2 on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Khagaria in connection with S.C. No. 348 of 2022 arising out of Maheshkhut P.S. Case No. 182 of 2021, subject to the following conditions:- (i) The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.
(ii) If the petitioner is found involved in future in the similar type of offence, his bail bond shall be liable to be cancelled.
