ANJANA MISHRA ORAL ORDER 05-04-2018 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner, being the mother-in-law of the deceased, is apprehending her arrest in connection with Jankinagar P.S. Case No.174 of 2017 for allegedly having committed the offence under Section 304B of the Indian Penal Code.

Learned counsel for the petitioner submits that the allegation is omnibus in nature and no specific allegation has been attached to the petitioner. It is further submitted that the entire family has been roped in though the petitioner as well as other family members had taken the deceased to hospital for treatment after the deceased got burnt while cooking. He

Patna High Court Cr.Misc. No.16221 of 2018 (2) dt.05-04-2018 2/2 further submits that the husband of the deceased lady has already been in jail custody.

Considering the aforementioned facts and circumstances, let the petitioner, above named, in the event of her arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Purnia, in connection with Jankinagar P.S. Case No.174 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Anjana Mishra, J) PNM U T
