1. Heard learned counsel for the parties.

2. The petitioner has preferred this application for grant of regular bail in connection with Excise P.S. Case no.692 of 2023 registered under section 30(a) of the Bihar Prohibition and Excise Act, 2016.

3. After some argument, in view of the observation of the learned Court below while rejecting prayer for bail of the petitioner, in order dated 15.9.2023 passed in Bail Petition no.2681 of 2023 wherein liberty has been granted to the petitioner to renew his prayer for bail after framing of charge, learned counsel for the petitioner prays to withdraw the instant application with liberty to the petitioner to renew his prayer for bail after framing of charge in the learned Court below.

4. In view of the above, the application stands disposed of as withdrawn with the aforesaid liberty.

5. It goes without saying that in case the petitioner renews his payer for bail, the learned Court below shall without being prejudiced by this order of withdrawal, shall take into consideration the observation given in the earlier order of rejection dated 15.9.2023 and pass orders in accordance with law.
