JUSTICE MOHIT KUMAR SHAH ORAL ORDER 30-01-2018 Heard the learned counsel for the petitioners and the learned A.P.P. for the State.
This is an application for grant of anticipatory bail in connection with Mahua P.S. Case No. 142 of 2017 registered for the offence punishable under Sections 147, 148, 323, 324, 325, 307, 504 and 149 of the Indian Penal Code.
The allegation against the accused persons is assaulting the prosecution side resulting in infliction of various types of injuries on the person of the informant and other members of the prosecution side.
The learned counsel for the petitioners submits that the petitioners herein are lady inmates and they are absolutely innocent and have been falsely implicated in the present case. A perusal of the case diary would show that no injury report is on
Patna High Court Cr.Misc. No.50778 of 2017 (4) dt.30-01-2018 2/2 record. The petitioners are stated to be having a clean antecedent. Having regard to the facts and circumstances of the case, I confirm the provisional bail granted to the petitioner no. 2, namely, Hamida Khatoon, vide order dated 09.11.2017 and, accordingly, steps be taken by the concerned court. It is further directed that the petitioner no. 1, namely, Nasarim Khatoon shall be admitted to the privilege of anticipatory bail, in the event of her arrest or surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Hajipur in connection with Mahua P.S. Case No. 142 of 2017 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
