Mr. Ashwani Kumar Tiwary, Advocate ====================================================== CORAM: HONOURABLE MR. JUSTICE DR. ANSHUMAN ORAL ORDER 12-02-2025 Heard learned counsel for the petitioner, learned counsel for the informant and learned A.P.P. for the State.

2. The prayer for bail of the petitioner has earlier been rejected vide order dated 19.03.2024 passed in Criminal Miscellaneous No. 77763 of 2023 with liberty to the petitioner to renew his prayer for bail in case the trial shall not conclude within six months.

3. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He is a student and is aged about 20 years only. He is in custody since 17.01.2023.

4. Learned counsel for the State opposes the prayer

Patna High Court CR. MISC. No.74616 of 2024(3) dt.12-02-2025 2/2 for bail.

5. Learned counsel for the informant opposes the prayer for bail and submits that on earlier occasion, a report with regard to the present stage of the trial and the time frame in which the trial is likely to be concluded, has been called for.

6. Upon perusal of the said report, it appears to this Court that only one witness is left to be examined, and the Trial Court has requested two months' time for disposal of the case.

7. In the present facts and circumstances, I am not inclined to grant regular bail to the petitioner.

8. Accordingly, the prayer for regular bail of the petitioner in connection with Sasaram (M) P.S. Case No. 628 of 2022, pending before the learned Additional Sessions Judge, 1, Rohtas, Sasaram is hereby rejected.

9. However, the trial Court is directed to release the petitioner on bail by imposing its own condition so that the petitioner may not evade his appearance during trial, if the trial is not concluded within two months.
