The petitioner seeks bail in connection with Jaipur Police Station Case No. 57 of 2019, registered for the offence punishable under Section 37 (c) of the Bihar Prohibition and Excise Act, 2016.

The allegation against the petitioner is that the police, on receiving information that some persons were creating nuisance under the influence of liquor, arrived at the place of occurrence and found that the petitioner had consumed alcohol. Learned Counsel for the petitioner submits that the petitioner has falsely been implicated in the present case with oblique motive. He further submits that the petitioner has got no criminal antecedent and he is in custody since 27.08.2019.

No.72557 of 2019(2) dt.11-12-2019 2/2 Having regard to the submissions made on behalf of the parties and taking into consideration the fact that the petitioner is in judicial custody since 27.08.2019 having no criminal antecedent, I am inclined to enlarge the petitioner on bail.

This application is, accordingly, allowed.

Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 20,000/- (twenty thousand) with two sureties of the like amount each to the satisfaction of learned 2nd Additional Sessions Judge, Banka, in connection with Jaipur Police Station Case No. 57 of 2019.
