The petitioners apprehend arrest in Barhara P.S. Case No. 343 of 2017 instituted for the offence under Sections 307/34 of the IPC and Section 27 of the Arms Act.

It is alleged in the written report that on the date of occurrence when informant was going to his home the accused persons came and fired from country made pistol causing injury in chest of the informant.

Learned counsel for the informant has submitted that in para 39 of the case diary it is mentioned that there is specific allegation against these petitioners. The injury report at paragraph 50 of the case diary mention that doctor has found

Patna High Court Cr.Misc. No.9586 of 2018(3) dt.03-04-2018 2/2 injury on the chest of the informant and the patient was referred to PMCH for treatment.

Keeping in view, the allegation against the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner.

Accordingly, this anticipatory bail petition stands rejected.

The petitioner is directed to surrender in the court below within six weeks from today and seek regular bail which will be considered by the court below in accordance with law, without being prejudiced by this order.
