JUSTICE VINOD KUMAR SINHA ORAL ORDER 18-10-2019 Petitioner seeks bail in anticipation of his arrest in connection with Uchakagaon P.S. Case No. 282 of 2018, registered for the offences punishable under Sections 147, 148, 149, 327, 337,338, 307, 427, 504, 353 of the Indian Penal Code. As per F.I.R. two groups were fighting between them and when police reached the place of occurrence they have started brick-bating on the police party also. Petitioner is also named in the F.I.R.

Submission of the learned counsel for the petitioner is that impugned order shows that there is no specific allegation attributed against him.

Heard learned A.P.P. also.

Having heard both sides, considering the above

Patna High Court CR. MISC. No.65023 of 2019(2) dt.18-10-2019 2/2 submission, this application allowed. Let the petitioner, above named, in the event of his arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Five Thousand) with two sureties of the like amount to the satisfaction of learned C.J.M. Gopalganj, in connection with Uchakagaon P.S. Case No.-282 of 2018, subject to the condition laid down under Section 438

(2) of the Code of Criminal Procedure and further condition is that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the Court concerned.
