JUSTICE RAVI RANJAN) 13-09-2018 It is contended on behalf of the appellant that the parties have reached to out of court's settlement and, as such, a petition under Section 13-B of the Hindu Marriage Act, 1955 (hereinafter referred to as "the Act") has already been jointly filed by the parties before the Principal Judge, Family Court, Purnea, bearing Matrimonial Case No.66/2018 on 23.04.2018. As such, learned counsel for the appellant submits that in view of such development having been taken place, he would seek leave to withdraw this appeal.
Accordingly, this appeal is dismissed as withdrawn with liberty to the parties to pursue their matter before the
Patna High Court MA No.877 of 2017(5) dt.13-09-2018 2/2 Family Court filed under Section 13-B of the Act. We hope and trust that expeditious steps should be taken by the court concerned for disposal of the same in accordance with law.
