The petitioner seeks bail in a case registered for the offence punishable under Sections 30(a), 32(2) of the Bihar Prohibition and Excise Act, 2016.

Prosecution case as lodged by the police personnel is that on secret information when he reached near Maratikar then two motorcycles were coming from Jharkhand. When both motorcycles were stopped then altogether 42 litres of illicit liquor were found in a bag kept on the Passion Pro motorcycle. Accordingly, a seizure list was prepared.

Learned counsel for the petitioner submits that there is no recovery from the conscious possession of the petitioner. He further submits that petitioner has no criminal antecedent and he

In the facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-II, Banka in connection with Panjwara Police Station Case No. 95 of 2019.
