====================================================== CORAM: HONOURABLE MR. JUSTICE SANDEEP KUMAR ORAL ORDER 30-10-2025 Heard learned counsel for the petitioners and learned A.P.P. for the State.

2. The petitioners seek regular bail in connection with Banjariya P.S. Case No. 382 of 2025, registered for the offences punishable under Sections 30(a), 32(1)(2), and 41(1)(2) of the Bihar Prohibition and Excise Act.

3. The recovery is of 2638.665 litres of foreign liquor.

4. Learned counsel for the petitioners submits that the petitioners are innocent and have committed no offence. It is further submitted that the petitioners are in custody since 11.07.2025 and claim to have clean antecedents.

5. Learned A.P.P. for the State has vehemently

Patna High Court CR. MISC. No.69758 of 2025(3) dt.30-10-2025 2/2 opposed the prayer for bail.

6. Considering the aforesaid facts and circumstances, this application for regular bail is allowed.

7. Let the petitioners, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Exclusive Special Excise Court No.-1, East Champaran, Motihari / concerned Court below in connection with Banjariya P.S. Case No. 382 of 2025, subject to the following condition:

(i) Initially, the petitioners shall be released on interim bail, and thereafter, after proper verification of their antecedents from the police officials of District-Jhajjar (Haryana), the bail shall be confirmed if they are found to have clean antecedents. In case it is reported to the Court below that the petitioners have any further antecedents, their interim bail shall be cancelled by the Court below.
