The petitioner is apprehending his arrest in connection with Barhara (Krishnagarh) P.S.Case no.316 of 2017, registered for offences punishable under Sections 341, 323, 342 & 354B/34 of the Indian Penal Code.
The petitioner is not named in the FIR. The allegation against the petitioner, as per FIR, is that he along with the other co-accused persons tried to drag the informant on the motorcycle, however, she raised hulla and thereafter they fled away. Submission of the learned counsel for the petitioner is that the allegation is against the co-accused persons and not against the petitioner and he is no way concern with the occurrence. Heard learned A.P.P. also.
Patna High Court Cr.Misc. No.3644 of 2018 (2) dt.01-02-2018 2/2 Having heard both sides and in view of allegation, this is not a case of grant of anticipatory bail rather let the petitioner surrender before the court below and make prayer for regular bail, who will consider the same on its own merit.
With the aforesaid observation, this application is dismissed.
