KUMAR ORAL ORDER 13-12-2017 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner, who is in custody, seeks bail in connection with Mahnar P.S. Case No. 107 of 2015 registered for the offence punishable under Section 395 of the Indian Penal Code.

It has been alleged by the informant in the FIR that 4 to 8 unknown persons committed robbery in his shop on 27.05.2015 and looted Rs. 2,50,000/- cash and also snatched a golden chain from his neck by pointing pistol and over powering him with the help of arms and whole episode has been recorded in C.C.T.V.

Learned counsel for the petitioner submitted that he is

Patna High Court Cr.Misc. No.49831 of 2017 (3) dt.13-12-2017 2/2 innocent and has committed no offence and petitioner has not been identified in C.C.T.V. footage. It has been further submitted that on confessional statement of co-accused Bijendra Paswan, the name of the petitioner has transpired in this case. Except confessional statement, no incriminating material has been recovered from his possession. It has further been submitted that similarly situated co-accused persons, namely, Ravi Kumar @ Ravi Singh Gope and Pappu Kumar Singh @ Pappu Singh have been granted bail by the Court below vide B.P. No. 951 of 2015 and 1008 of 2015 respectively and he is in custody since 19.05.2017.

Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Vaishali at Hajipur, in connection with Mahnar P.S. Case No. 107 of 2015.
