The petitioner apprehends his arrest in connection with Giriyak P.S. Case No. 240 of 2017 registered under Sections 341, 323, 325, 307, 504 and 506/34 of the Indian Penal Code. The accusation is that petitioner and seven other persons named in the F.I.R. made accused with general allegation of causing injury to the uncle of the informant without any specific overt act against the petitioner.
Learned counsel for the petitioner submits that similarly situated co-accused, Umesh Yadav, Rajendra Yadav, Kunal Yadav and Sakaldeo Yadav, have already been granted
Patna High Court Cr.Misc. No.8747 of 2018 (2) dt.17-02-2018 privilege of pre-arrest bail by this Court vide order dated 06.12.2017 passed in Criminal Misc. No. 45974 of 2017. Further submission is that petitioner has no criminal antecedent. Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-VI, Nalanda at Biharsharif, in connection with Giriyak P.S. Case No. 240 of 2017, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
