2. The petitioner seeks bail in a case registered for the offence punishable under Sections 144, 506 and 120 (B) of the I.P.C and Sections 10, 13, 18 and 20 of UAPA Act.
3. As per the prosecution case, the allegation against the petitioner is that he had stuck up pamphlet on a wall with regard to Bihar Bandh.
4. Learned counsel for the petitioner submits that the only allegation against the petitioner is that he had stuck up pamphlet on the wall with regard to Bihar Bandh and no other allegation of any larger conspiracy etc. has been attributed to the petitioner. It is further submitted that the petitioner was not

No.73409 of 2025(4) dt.11-02-2026 2/3 arrested from the spot and his name was disclosed by some villagers who also did not disclose their name as such the complicity of the petitioner is not based on specific source of information. Other police cases have also been filed against him on same type of false allegations and as such the petitioner has list of criminal antecedents. Further, the petitioner is in custody since 22.08.2024 but the stage of the trial has not moved any further.
5. Learned A.P.P. for the State opposes the bail petition on the ground that petitioner has several criminal antecedents.

Taking into consideration the facts and circumstances of the case and also considering the fact that the allegation upon the petitioner is with regard to sticking a pamphlet and nothing beyond that to suggest a larger conspiracy and further considering that charge sheet has already been submitted and petitioner undertakes that he would not abscond or tamper with the evidence, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending/successor Court in connection with
Patna High Court CR. MISC. No.73409 of 2025(4) dt.11-02-2026 3/3 Birpur P.S. Case No. 86 of 2018, subject to the conditions that : (i) One of the bailors will be his close relative/family members.
(ii) The petitioner shall remain physically present in court on each and every date fixed in the case till the framing of charges and in the event of failure on two consecutive dates without sufficient reasons, his bail bonds shall be liable to be cancelled by the learned court concerned.
