The petitioner seeks bail in connection with Birpur P.S. Case No. 70 of 2019, registered for the offence punishable under Sections 399 and 402 of the Indian Penal Code and Sections 26 and 35 of the Arms Act.

Learned counsel appearing on behalf of the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. Further submission is that similarly situated co-accused persons have been granted bail by a co-ordinate Bench of this Court in Cr. Misc. No. 47932 of 2019 vide order dated 08.08.2019, Cr. Misc. No. 47945 of 2019 vide order dated 08.08.2019 and Cr. Misc. No. 49185 of 2019 vide order dated 07.08.2019. The petitioner is in custody since

Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, let the above-named petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate 1st Begusarai in connection with Birpur P.S. Case No. 70 of 2019.
