In this case, the petitioners are seeking anticipatory bail in connection with Masaurhi P.S. Case No.372 of 2019, registered for the offence punishable under Sections 341, 323, 448, 504, 506, 308, 354/34 of the Indian Penal Code. Allegation has been made that the accused persons including the petitioners have assaulted the informant and also misbehaved his wife, however, counsel for the petitioners submits that there is case and counter case from both sides and prior to lodging of the present case, the co-accused had filed a case bearing Masaurhi P.S. Case No. 371 of 2019 and both the

Patna High Court CR. MISC. No.72718 of 2019(5) dt.15-07-2020 2/2 parties are said to have suffered simple injury inasmuch as the case diary shows that injury is there but ultimate result has not been mentioned.

Looking to the entire facts and circumstances of the case, let the petitioners, above-named, be released on anticipatory bail in the event of their arrest or surrender before the learned Court below within a period of eights weeks from today, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) each with two sureties of the like amount each to the satisfaction of the Judicial Magistrate-1st Class, Masaurhi, Patna in connection with Masaurhi P.S. Case No. 372 of 2019, subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure with a further condition that whenever the police will call the petitioners for the purposes of investigation and interrogation, they will remain present for the investigation.
