JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 07-11-2023 Heard the learned counsel for the petitioner as well as the learned Additional Public Prosecutor for the State. The petitioner apprehends his arrest in connection with Dhaka (Pachpakari) P.S. Case No. 498 of 2022 registered for the offences punishable under Section-366A read with 34 of the Indian Penal Code.

Allegedly, the minor daughter of the informant was enticed away by the accused persons for the purpose of marriage.

Learned counsel for the petitioner has submitted that in her statement recorded under Section 164 of the Cr.P.C., the victim has stated that she along with the petitioner went to Nepal with her own sweet will. Further in her statement, she,

Learned Additional Public Prosecutor opposed the prayer for bail.

Considering the above-mentioned facts and circumstances, the petitioner above-named, in the event of their arrest or surrender, within four weeks from today, are directed to be released on bail on furnishing bail bonds of Rs.10,000/- each with two sureties of the like amount each to the satisfaction of learned Additional District & Sessions Judge-VI-cum-Special Judge, POCSO Act, East Champaran in connection with Dhaka (Pachpakari) P.S. Case No. 498 of 2022, subject to condition as laid down under section 438(2) Cr. P.C.
