The petitioner is accused in connection with Kursakanta (Sonamani Godam O.P.) P.S. Case No. 137 of 2019, registered under Section 414 of the Indian Penal Code and Section 11 of the Prevention of Cruelty of Animal Act, 1960. The accusation is that on receiving secret information about carrying the cattle from Nepal to India, the informant along with other police personnel proceeded to that direction and saw that some persons were carrying the cattle towards bridge. Thereafter, on chased, nine persons named in the FIR were apprehended, while some others succeeded to flee away. At that time, 21 cattle were seized and the caught hold

Patna High Court CR. MISC. No.74433 of 2019(2) dt.18-12-2019 2/2 persons disclosed that the seized cattle belonging to Md. Mokhtar Ansari (petitioner) and Md. Hakim, who succeeded to flee away.

Learned counsel for the petitioner submits that petitioner was not apprehended at the spot rather his name has been disclosed by the persons, who were apprehended at the spot. It is further submitted that petitioner has no criminal antecedent and is in custody since 11.08.2019 and the charge sheet has already been submitted against the petitioner. Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the A.C.J.M.-V, Araria, in connection with Kursakanta (Sonamani Godam O.P.) P.S. Case No. 137 of 2019. Out of two sureties, one surety must be the close relative of the petitioner.
