JUSTICE MOHIT KUMAR SHAH ORAL ORDER 22-11-2024 The present petition has been filed by the petitioner no.2 of the original anticipatory bail petition, for modifying the order dated 09.10.2020, passed by this Court, in Cr. Misc. No.23873 of 2020, to the extent of extending the time granted to the petitioner herein to surrender before the learned Court of Judicial Magistrate 1st Class, Danapur (Patna) in connection with Maner P.S Case No. 03 of 2020 for being admitted to the privilege of anticipatory bail, by a further period of two weeks from today.
2. The learned counsel for the petitioner herein submits that the rest of the two petitioners of the aforesaid anticipatory bail petition have already surrendered and have been admitted to the privilege of anticipatory bail, however, the present petitioner is a labour, who is working outside the State of Bihar for his livelihood, hence he could not gain knowledge of the aforesaid
Patna High Court CR. MISC. No.79503 of 2024(2) dt.22-11-2024 2/2 order dated 09.10.2020, thus, he could not surrender within the time granted by this Court. Nonetheless, a sympathetic view be taken and the time granted to the present petitioner to surrender before the learned Trial Court and obtain anticipatory bail be extended by a period further of two weeks from today.

Having regard to the facts and circumstances of the case and considering the submissions made by the learned counsel for the petitioner, I deem it fit and proper to modify the order dated 09.10.2020, passed in Cr. Misc. No.23873 of 2020 qua the petitioner herein and grant him two weeks' further time from today for surrendering before the learned Court of Judicial Magistrate1st Class, Danapur (Patna) in connection with Maner P.S Case No. 03 of 2020, for being admitted to the privilege of anticipatory bail.
4. Accordingly, the present petition stands disposed off with the aforesaid modification in the order dated 09.10.2020, passed in Cr. Misc. No. 23873 of 2020, however the rest of the order dated 09.10.2020 shall remain as it is. (Mohit Kumar Shah, J) Kanchan,suruchi/- U T
