Learned counsel for the petitioner is permitted to remove the defect(s), as pointed out by the office, if any, within a period of four weeks from today.

Petitioner seeks bail who is in custody since 26.10.2016 in connection with Barauni (Chakia) P.S. Case No. 382 of 2016, F.I.R. dated 26.10.2016 for the offences punishable under Sections 115, 353, 307/34 of the Indian Penal Code and Section 25(1-b)a, 26, 27 and 35 of the Arms Act. According to prosecution case, huge quantity of fire arms have been found including carbine, automatic pistol, country made pistol etc., from the possession of the accused

Learned counsel for the petitioner submits that petitioner has falsely been implicated in the present case. He further submits that it appears from the F.I.R. as well as seizure list that huge quantity of arms and ammunition have been recovered from the possession of the petitioner and other accused persons.

The learned Additional Public Prosecutor has vehemently opposed the prayer for bail of the petitioner and submits that the petitioner carries 27 cases other than the present one.

Vide order dated 28.04.2023 a report was called with regard to the present stage of trial. Report of the learned Trial Court dated 25.04.2023 reveals that out of 5 charge sheet witnesses, 3 witnesses have already been examined by the prosecution and the case is pending for rest of the examination of the prosecution witnesses.

Considering the aforesaid facts circumstances, I am not inclined to enlarge the petitioner on bail in connection with Barauni (Chakia) P.S. Case No. 382 of 2016 pending in the court of learned Additional Sessions Judge-III, Begusarai. Prayer is refused.
