2. The petitioner apprehends his arrest in connection with Chandi P.S. Case No. 73 of 2023, registered for the offences punishable under Sections 147, 148, 149, 323, 336, 337, 338, 326, 307, 302, 504, 506 of the Indian Penal Code and U/S 27 of Arms Act.
3. As per allegation, when the informant was in his house, the accused persons named in the FIR, equipped with brick bat and stones, came there and started indiscriminate firing and they also threw bricks and stones upon him. When his son came to save him, they opened fire on him, causing head injury. Further, they assaulted one Raviranjan Kumar, Surendra Singh,
Patna High Court CR. MISC. No.72923 of 2023(3) dt.29-02-2024 2/2 Chandra Shekhar Kumar and one Chinta Devi.
4. Learned counsel for the petitioner has submitted that the petitioner is a person of clean antecedent and has falsely been implicated in this case. The allegations are general and omnibus.
5. Learned APP for the State has vehemently opposed the prayer for bail and submitted that paragraph no. 73 of the case diary itself shows that the deceased died due to injuries suffered by fire-arm, as such, he does not deserve privilege for bail.
6. Considering the above-mentioned facts and circumstances, I am not inclined to grant anticipatory bail to the petitioner, which is hereby rejected.
