JUSTICE ARUN KUMAR ORAL ORDER 13-02-2018 Heard learned Counsel for the petitioner and the State as also the learned Counsel appearing on behalf of Union of India. Petitioner, already in custody, seeks bail in Adapur PS Case No. 209 of 2017, NDPS Case No. 65 of 2017 registered under Sections 20, 22, 23, 24 and 25 of the NDPS Act. The allegation in brief is that on secret information the police led trap and apprehended three persons and a few escaped away leaving behind four bundles in which Ganja was found and this petitioner was carrying 12 Kg of Ganja.
Learned Counsel for the petitioner submits that recovery from the petitioner is only 12 KG Ganja and has no criminal antecedent, charge-sheet has been submitted and another co-accused Bidur Rai, similarly situated from whom recovery is of 13 Kg Ganja, has been admitted to bail by a coordinate Bench of this Court. Having considered the said facts and circumstances, the petitioner, namely, Guddu Sahani is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two
