2. The petitioner seeks regular bail in connection with Paraiya P.S. Case No. 410 of 2023 registered for the offence under Section 30(a) of the Bihar Prohibition and Excise Act, 2018.

3. As per the prosecution case, total 10 litres of illicit country made mahua liquor was recovered from the possession of the petitioner.

4. Learned counsel for the petitioner submits that petitioner is innocent and has not committed any offence. Petitioner is in custody since 04.09.2024 having three criminal antecedents and in two cases he is on bail.

5. Learned A.P.P. has vehemently opposed the prayer for bail.

6. Considering the facts and circumstances of the case and also considering the period of custody, this application for regular bail is allowed.

7. Let the petitioner above named, be granted bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand Only) with two sureties of the like amount each to the satisfaction of learned court of Exclusive Special Judge, Excise, 2nd Gaya in connection with Paraiya P.S. Case No. 410 of 2023, subject to the condition that the petitioner after being released on bail is directed to mark his attendance at Paraiya Police Station at First and Third Sunday of each month. Any default in appearance at the police station will result in cancellation of bail bonds of the petitioner.

8. The petitioner shall deposit an amount of Rs. 10,000/- (Rupees Ten Thousand Only) in Ramakrishna Mission Ashrama, Nala Road, Patna and produce the receipt of the same before the Court below. The bail bonds of the petitioner shall be accepted after verifying the genuineness of the receipt produced by the petitioner.
