JUSTICE AJAY KUMAR TRIPATHI) 24-01-2018 Vide order dated 22.08.2017, two weeks time was granted for filing petition for substitution of respondent no.8, which was not done. In view of the same, the appeal stood dismissed against respondent no.8.
The present petition has now been filed seeking expunction of the name of respondent no.8 since she is said to be dead leaving no legal heirs. It is also stated that even though she was a party, she had never contested the matter at any such
Patna High Court MJC No.2892 of 2017(3) dt.24-01-2018 2/2 before any forum.
In view of the same, the MJC application is allowed. Respondent no.8 is ordered to be expunged in LPA No.1376 of 2015.
