JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 26-04-2018 Petitioner has moved this Court for a direction to the respondent authorities to arrest the accused persons involved in Gardanibagh P.S. Case No. 192 of 2017 dated 25.05.2017 under Sections 406, 420, 467, 468, 472 and 120-B/34 of the Indian Penal Code.
The writ application was preferred on 16.11.2017. Today the matter was listed on Bench slip accepted by this Court, but no one has appeared to press this application. Learned counsel for the State is present.
In the facts and circumstances stated in the writ application it is the submission of the learned counsel for the State that in absence of the records of the case and the present position
Patna High Court Cr. WJC No.2323 of 2017 (2) dt.26-04-2018 no direction may be issued by this Court at this stage. Considering his submission, the writ application is disposed of giving liberty to petitioner to agitate this issue before the court below, who is in seisin of the matter, and on the petitioner making an appropriate application, the court below would be in a position to consider the same with reference to the materials available on the record.
