JUSTICE ASHUTOSH KUMAR ORAL ORDER 06-12-2021 Heard Mr. Gagan Deo Yadav, the learned Advocate for the petitioner and Mr. Shashi Bhushan Singh, the learned counsel for the informant. The State is represented by the APP.
The petitioner seeks bail in anticipation of his arrest in connection with Mohammadpur P.S. Case No. 158
Patna High Court CR. MISC. No.72916 of 2019(4) dt.06-12-2021 2/3 of 2017, dated 16.06.2017, instituted for the offences under Sections 420, 406, 467, 468 and 120(B)/34 of the Indian Penal Code.
The petitioner is alleged to be the Managing Director of an Automobile Agency. He is alleged to have falsely prepared documents for giving a City Honda car to somebody without due authorization. The modus operandi as narrated in the F.I.R. is that the vehicles used to be financed twice by two loan disbursing banks.
It has been submitted on behalf of the petitioner that the accusation is absolutely false. The petitioner had left the services of the Automobile Agency because of the bad behaviour of the proprietor. It has further been submitted that the proprietor of the company has got this case lodged against him by his Accountant.
In any view, this Court is not entering into the merits of the controversy for the reason that the petitioner has been declared an absconder.
The prayer for grant of anticipatory bail to the petitioner is, therefore, rejected.

No.72916 of 2019(4) dt.06-12-2021 3/3 However, if he surrenders before the Court below and seeks bail, the Court below shall consider the case on its own merits, without being prejudiced by the fact that the present anticipatory bail application has not been entertained by this Court.
With the aforesaid observation/direction, the application stands disposed off.
