JUSTICE PURNENDU SINGH ORAL ORDER 17-05-2023 Heard learned counsel appearing on behalf of the petitioners and learned A.P.P. for the State. The petitioners apprehend their arrest in connection with K. Hat (Maranga) P.S. Case No. 45 of 2018, registered under Sections 147, 149, 186, 371, 323, 353, 290 and 291 of the Indian Penal Code.

The prosecution case, in brief, is that seven persons

Patna High Court CR. MISC. No.73811 of 2022(3) dt.17-05-2023 2/2 named in the F.I.R. along with 100 and above unknown persons had blocked the NH-31.

Learned counsel appearing on behalf of the petitioners submitted that the petitioners were just simply the member of the mob and they have falsely been implicated in this case.

Learned A.P.P. for the State has vehemently opposed the prayer for grant of pre-arrest bail to the petitioner. Having considered the rival submission of the parties, and the material available on the record, let the above named petitioners, be released on bail, in the event of their arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Purnea, in connection with K. Hat (Maranga) P.S. Case No. 45 of 2018, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
