The petitioner seeks bail in a case registered for the offence punishable under Sections 304(B) and 201 of the Indian Penal Code.

Accusation against the petitioner is of committing torture upon the victim and due to non-fulfillment of demand of dowry, the informant's daughter has been killed by her husband (petitioner) and in-laws and her dead body has been disposed of. Learned counsel for the petitioner submits that the petitioner bears no criminal antecedent, he is in custody since 29.05.2019 and on suspicion he has been falsely implicated. He submits that during investigation except the mother and brother of the deceased, none has supported the prosecution story.

No.66947 of 2019(3) dt.04-12-2019 2/2 Considering the facts and circumstances of the case as well as the fact that petitioner is the husband of the deceased, I am not inclined to enlarge the petitioner on bail. Accordingly, his payer for bail is rejected in connection with Bhorey P.S. Case No. 157 of 2018 pending before the court of the learned Chief Judicial Magistrate, Gopalganj.

Accordingly, the application is dismissed.
