The petitioner apprehends his arrest in Sakri P.S. Case No.133 of 2017 registered under Sections 272, 273, 290/34 of the Indian Penal Code and 30(a) of Bihar Prohibition and Excise Act, 2016.

The police got information that in old market, liquor was being sold and on such the police went there and arrested Raj Kumar Sahni while he was fleeing away. The police raided the house of Raj Kumar Sahni and 15 bottles of Royal Stag whisky, containing 750 ml each, were recovered. Raj Kumar Sahni disclosed the name of the petitioner, Lalan Singh, and disclosed that Lalan Singh sent liquor to him for selling. The learned counsel for the petitioner submits that there is

Patna High Court Cr.Misc. No.5170 of 2018 (2) dt.02-02-2018 2/2 no material to show the involvement of the petitioner and nothing has been recovered from the possession of the petitioner. Considering the facts aforesaid and the fact that the name of the petitioner figured in the case on the basis of so called confessional statement of Raj Kumar Sahni and from whose house 15 bottles of Royal Stag liquor was recovered, the petitioner, above named, in the event of his arrest or surrender before the learned Court below within a period of four weeks from the date of receipt / production of a copy of this order is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned IInd Additional Sessions Judge, Madhubani in connection with Sakri P.S. Case No.133 of 2017, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
