1. Heard learned counsel for the petitioner and learned A.P.P. for the State.
2. The petitioner seeks bail in a case registered for the offences punishable under Sections 272, 273 and 420/34 of the Indian Penal Code as well as Sections 30(a) and 41(i) of the Bihar Prohibition and Excise Act, 2016.
3. Learned counsel for the petitioner submits that petitioner has antecedent of two cases and is in custody since 11.09.2024.
4. Allegation is of recovery of 11.600 litres of liquor from a truck.
5. Learned counsel for the petitioner submits that petitioner was not arrested from the spot as such nothing was recovered from his conscious possession and he came to be
Patna High Court CR. MISC. No.73818 of 2024(2) dt.18-10-2024 2/2 implicated based on the fact that he is owner of the seized truck. It is further submitted that no prudent person would use his own vehicle for committing an occurrence and thus would create evidence against himself and hence would get implicated.
6. Learned A.P.P. for the State opposes the prayer for regular bail of the petitioner.
7. Considering the submission, the petitioner, above named, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Sonpur P.S. Case No. 1118 of 2023.
