====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 29-04-2023 Heard learned Senior counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks bail in a case registered for the offences punishable under Sections 341, 323, 307, 379, 354, 504, 506 and 34 of the Indian Penal Code.

Learned Senior counsel for the petitioner submits that the petitioner is in custody since 18.08.2022 and is a person with clean antecedent and is the brother of the husband of the informant.

Learned Senior counsel for the petitioner submits that petitioner being brother of the husband of the informant has been falsely implicated with an allegation that he assaulted the informant on her head causing injury approximately 10 inches

Patna High Court CR. MISC. No.70516 of 2022(2) dt.29-04-2023 2/2 in length by an iron rod. The learned Senior counsel submits that as far as allegation of dowry is alleged, the same is general and omnibus in nature, it is next submitted that charge-sheet has been submitted and the petitioner will not abscond. Learned A.P.P. for the State vehemently opposes the prayer for bail of the petitioner.

Considering the fact that the petitioner is in custody, is a person with clean antecedent and charge-sheet has been submitted in the case, let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Gadhpura P.S. Case No. 128 of 2019.
