The petitioners apprehend their arrest in connection with Hajipur town P.S. Case no. 210 of 2016, registered under Sections 341, 323, 448, 504, 506, 354, 308 and 380/34 of the Indian Penal Code.
The accusation is that both the petitioners along with five unknown reached at the door of the informant and started to abuse him when the informant made protest then petitioner No.2 Vishal Singh caused injury through country made pistol and petitioner No.1 Shyam Narayan Singh caused injury through iron rod at the back of the informant, when brother of the informant rushed to save him then he was also assaulted by them. At that time, Vishal Singh caused injury to the wife and sister-in-law of the informant by means of fist and slaps.
Patna High Court Cr.Misc. No.51493 of 2017 (2) dt.01-11-2017 2/2 Learned counsel for the petitioners submits that, in fact, the informant and petitioners are co-villagers and due to some grudge the petitioners have falsely been implicated in this case. Moreover, the injuries as found on the person of the informant and his brother are simple in nature caused by hard and blunt substance. Further submission is that petitioners have no criminal antecedent. Having regard to the facts and circumstances of the case, let the above named petitioners, be released on bail, in the event of their arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Vaishali at Hajipur in connection with Hajipur Town P.S. Case No. 210 of 2016, subject to the condition as laid down under Section 438 (2) of the Cr.P.C. (Rajendra Kumar Mishra, J) manish/- U T
