JUSTICE VINOD KUMAR SINHA ORAL ORDER 18-10-2019 Petitioner seeks bail in anticipation of his arrest in connection with Itarhi P.S. Case No. 203 of 2019 registered for the offences punishable under Sections 403, 406, 420, 421 and 424 of the Indian Penal Code.

As per FIR petitioner is said to be Chairman of the Bikram-English PACS and he has to deposit CMR to the extent of 2304 quintal 80 kg. and only 1350 quintal has been deposited and as such he has defalcated total amount of Rs.27,03,900.68/-. Submission of learned counsel for the petitioner is that though the allegation is false and concocted but he is still ready to deposit the amount subject to the result of the case if some reasonable time is granted to him.

No.64683 of 2019(3) dt.18-10-2019 2/2 In view of above facts and circumstances, let petitioner surrender in the court below by 19.11.2019 along with a Bank Draft of Rs.7.39 lac in favour of Co-operative Bank, Ara, and on such deposit he shall be released on provisional bail for a period of five months and during that period he has to deposit rest of the amount in five equal instalments of Rs.5 lac each. Once the total amount is deposited the bail bond of the petitioner shall be confirmed. It is also made clear that if the total amount is not deposit within the said period, his bail bonds shall be cancelled. It is also made clear that above payment shall be subject to final outcome of the case.
