2. Certified copy of the charge-sheet is taken on record.

3. The petitioner seeks regular bail in connection with Terhagachh P.S. Case No. 43 of 2024, registered for the offence punishable under Sections 302/34 of the Indian Penal Code but the charge-sheet has been submitted under section 306 of the Indian Penal Code.

4. As per prosecution, petitioner is the husband of the deceased and he is accused of killing the deceased after torturing her.

5. Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case. Petitioner bears clean antecedent and is in judicial custody since

6. Learned APP has vehemently opposed the prayer for bail.

7. Considering the aforesaid fact that the charge-sheet has been submitted under section 306 of the I.P.C., this application is allowed.

8. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned court of Judicial Magistrate, 1st Class, Kishanganj, in connection with Terhagachh P.S.
