Petitioner apprehends his arrest in Nawada P.S. Case No.698 of 2016 for the offences under Sections 420, 467, 468, 471 and 34 of the Indian Penal Code.
Allegation, as per the F.I.R., against the petitioner is that he along with the accused persons got sale deed executed in favour of the informant with respect to the land which is not of the accused persons and, as such, they have committed forgery and also cheated the informant.
Learned counsel for the petitioner submits that he is only a witness on the sale deed and he has not executed the sale deed and other co-accused who is also witness on the sale deed has already been granted privilege of anticipatory bail vide order
Patna High Court Cr.Misc. No.12903 of 2018 (2) dt.03-04-2018 2/2 dated 26.02.2018 passed in Cr.Misc.No.8164 of 2018. Heard learned A.P.P. as well as the informant who opposed the prayer for anticipatory bail of the petitioner. Having heard both sides and in view of the facts and circumstances of the case and other similarly situated co-accused have already been granted anticipatory bail, prayer for anticipatory bail is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks from today, be released on bail on furnishing bail bond of Rs.25,000/- with two sureties of the like amount each to the satisfaction C.J.M., Nawada, in Nawada P.S. Case No.698 of 2016 subject to the conditions as laid down under Section 438(2) of Cr.P.C. and further conditions that his bailors must be of local having sufficient immovable property within the jurisdiction of the Court and the petitioner shall cooperate in the investigation.
