JUSTICE VINOD KUMAR SINHA ORAL ORDER 18-10-2019 This is an application for grant of anticipatory bail in connection with Parsa Bazar P. S. Case No. 201 of 2019, disclosing offences under Sections 147, 148, 149, 341, 323, 307, 379, 354 and 504 of IPC.

As per F.I.R. petitioner no.1 is said to have assaulted by rod on the head of the informant and petitioner no.2 by lathi on the head of the informant and petitioners no.3 to 5 are also named in the F.I.R. without any allegation of assault. Submission of the learned counsel for the petitioners is that there is case and counter case between the parties. There

Patna High Court CR. MISC. No.64952 of 2019(2) dt.18-10-2019 2/2 is land dispute between the parties and there was no intention behind causing the injuries and no offence is made out under Section 307 of IPC and so far under Sections 504 and 379 of IPC that appears to be ornamental in nature.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount to the satisfaction of learned Additional Chief Judicial Magistrate- VIII, Patna, in connection with Parsa Bazar P. S. Case No. 201 of 2019, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
