Petitioner seeks bail in connection with Sahebganj P.S. Case No. 223 of 2012 registered for the offence punishable under section 396 of the Indian Penal Code and Section 27 of the Arms Act.

Learned counsel appearing for the petitioner submits that petitioner is not named in the first information report and he has been implicated in this case on basis of confessional statement of the co-accused. Nothing has been recovered from the conscious possession of this petitioner. Similarly situated co-accused persons have been granted bail by a co-ordinate Bench of this Court vide Annexure-2.

Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, I, Muzaffarpur (West) in connection with Sahebganj P.S.
