The petitioner has filed this petition for restoration of Cr. Misc. No. 5353 of 2018, which was dismissed for non compliance of peremptory order dated 07.02.2018 by which requisites for notice was to be filed within ten days from the date of order.

The learned counsel for the petitioner submits that requisites for notice has already been filed though after the prescribed date. The learned counsel for the petitioner submits that on account of his fault, Cr. Misc. No. 5353 of 2018 was dismissed.

Considering the facts aforesaid, the restoration petition is allowed and Cr. Misc. No. 5353 of 2018 is restored to its original file. The office is directed to issue notice to opposite party No.2.
