2. Petitioner apprehend their arrest in a case registered for the offence punishable under sections 126 ( 2 ), 329 ( 4 ), 115 ( 2 ), 109, 351 ( 2 ), 303 ( 2 ), 352, 103 and 3 (5) of the BNS.

3 . As per F.I.R., informant namely, Neelam devi alleged that on 02.01.2025 at about 06:00 AM, all the accused persons along with 2 to 3 unknown persons came and assaulted husband of informant and in course of assault co-accused Situ Ram assaulted on the head of husband of informant with lathi due to which he became unconscious and died during course of treatment.

4. It is submitted on behalf of the petitioner that

Patna High Court CR. MISC. No.69752 of 2025(3) dt.07-11-2025 2/2 specific accusation of assault on the head of deceased is against Situ Ram. So far as this petitioner is concerned concerned allegation is general and omnibus against him. As per Postmortem report, deceased died due to head injury which is grievous in nature and others injury are simple in nature . Petitioner claims clean antecedent.

5 . Learned counsel for the State oppose the bail petition .

6 Considering the aforesaid facts, clean antecedent of this petitioner and other circumstances of the case , in the event of arrest or surrender within eight weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class Nawada in connection with Warisalihanj P.S. Case No. 08 of 2025 , subject to the conditions laid down under section 482 ( 2 ) of the Bharatiya Nagarik Suraksha Sanhita ( BNSS) , 2023 .
